6. Data Breach Response Requirements

MBBP Privacy & Data Security Series - #6: Attorney Sandra Kahn provides tips to companies that handle personal information on how to respond to a data breach. When a data breach occurs any business that owns or licenses personal information of a Massachusetts resident must make three types of notifications:

1. To the Massachusetts Attorney General
2. To the Director of Consumer Affairs and Business Regulation
3. To the affected resident.

The law provides detail on what these notices must provide.

Companies that suspect or believe that they have experienced a data breach should contact an privacy attorney to determine whether a breach has occurred under the law, and if so, what steps must be taken to address it.
