NSA slapped on Greater Noida builder | Noida News
NOIDA: In what could serve as a deterrent for developers engaging in unauthorised constructions, the district administration on Wednesday slapped the National Security Act (NSA) on builder Shahbuddin Khan in connection with the July 17, 2018, twin building collapse in Shahberi, in which nine people lost their lives.
This is the first case in Uttar Pradesh in which a builder has been detained under the stringent NSA.
Khan, who is from Meerut, has been in detention under the Gangster Act since July 25 this year and had applied for bail in the district court, which was rejected on August 13. He has now moved the Allahabad high court for bail. The plea is up for hearing on September 4.
Khan has been detained under Section 3(2) of the NSA, wherein the district magistrate has the power to take preventive detention of up to one year if anyone is found disrupting public order in the district.
Coming down heavily on rampant illegal construction, District magistrate BN Singh put 47-year-old Khan in the ‘rogue builder’ category and said similar action will be taken against errant builders. So far, 253 cases have been lodged and 64 arrests have been made.
“A 34-page report of the additional district officer has noted that buildings in Shahberi have been built without necessary clearances. While the structure is weak, there are no Authority permits, no map clearances or building plans cleared. This is in defiance of high court stay order of 2014. Builders continued with construction and fooled buyers. Hence, builders like Shahbuddin have been held responsible and detained under NSA,” said Singh.
He added that builders are being held responsible for acts against public order. “Shahbuddin has been found to be under ‘rogue builder’ category where such builders are known to continue acts of disruption/illegal construction despite legal deterrents. Hence, he has to be detained. Action of NSA will be taken only on rogue builders and not regular builders,” said Singh.
