Question of the Day: How do you handle a data breach under the GDPR?

The General Data Protection Regulation (GDPR) is an EU law that goes into effect on May 25, 2018.
Data protection must be by design and default.

You must report the breach to the supervisory authority without undue delay within 72 hours of learning of it unless its unlikely to result in a risk to the rights and freedoms of natural persons and include the likely consequences of the breach and measures to mitigate possible adverse effects.

You must inform data subjects without undue delay if the breach is likely to result in high risk to the rights and freedoms of natural persons.

Failure to comply could result in millions of dollars in fines.

If legal questions were easy, we wouldn’t need lawyers.
